The Approved LHCA Amendments to Protective Covenants & By-Laws Have Been Recorded & Posted on Our Sites

On September 29, 2023, the Board announced the passage of the proposed Protective Covenant Ballot. At that time, we had received the required quorum of votes for passage. Even though we had achieved the 67% positive response, State Law required the Association to send a notice to owners that did not respond, with a ballot, to allow 20 additional days to cast their vote. That date was October 10. After that date, the Board executed the documents and provided them to our management company for filing.

The following documents have been recorded in the Official Public Records of Real Property of Harris County, Texas: First Amendment to the By-Laws of Lake Houston Community Association, recorded 01/11/2024 and First Amendment to the Kings Crossing, Section Eighteen Protective Covenants, recorded 02/02/2024.

Protective Covenant Ballot / Vote Status

The Board would like to thank all homeowners that participated in the Protective Covenant voting.  And thank you to all that volunteered your time to reach out to neighbors to make sure they were aware of the mailing and collecting ballots.  A special “Thank You!” to Thornton & Barbara House and Ruby Jones for spending days in our high-temperature heat checking in with our Enclave neighbors regarding the ballots.  

The Board is pleased to announce that we have received the required quorum of votes.  Now that we have received the 67%, State Law requires the Association to send a notice to owners that did not respond, with a ballot, to allow 20 additional days to cast their vote if they have not done so.  Once that is complete then the amendments can be executed by the Board and then filed.

Many of you seem to have set aside your letter and ballot that was sent out a few weeks ago. For the proposals to be adopted we will need to collect many more ballots than what have been returned as of the last couple of weeks.

Without your vote, nothing will change

And in case you have misplaced your ballot form, one is attached that you can print. If you need assistance, please ask a neighbor or let us know. The Board will be happy to get a ballot to you or collect the completed ballot and email to Vickie Cain.

As a reminder, the proposals to the Protective Covenants:

  • Article II, Section 2 adds wordage on garage sale, rummage sale, moving sale or similar activity, Association sponsored community-wide garage sale and Estate sales.
  • Article II, Section 18 updates garbage cans or other trash receptables location and time of curb placement.
  • Article VI, Section 4 and Section 5 removed as no longer applicable
  • Article VI, Section 8 updates Protective Covenants in include leasing and associated guidelines

Please return completed & signed ballots by Monday, September 25 to ensure to be counted. The Ballot must be returned/RECEIVED by September 26, 2023 by 1:00 AM. Lake Houston Community Association (LHCA) Proposed Revisions, Deletions and Updates

PLEASE VOTE – Deadline September 26

Homeowners recently received a letter from the LHCA Board regarding proposed revisions, deletions and updates to the Lake Houston Communication Association’s By-laws and Protective Covenants. (See Below)

A list of the proposals to the By-laws:

  • Article II, Section 7 and Section 8 are removals of items no longer applicable
  • Article IV, Section 1. Number is amended to change that Board members must be Member of the Association.
  • Article V, Section 1. Nomination is amended to remove reference to a nominating committee and incorporate electronic postings and email notification
  • Article VII, Section 1(j) removed as no longer applicable
  • Article VIII, Section 8(c) and Section 8(d) remove reference to “Corporate Seal”
  • Article XVI, Section 2 Add Board my set the fiscal year to align with accounting services provider

A list of the proposals to the Protective Covenants

The only way these proposed revisions, deletions and updates will be adopted for the protective covenants is with the approval of 67% of the homeowners, one vote per address.

      The additions are to address items that are not specifically addressed in either the by-laws or protective covenants and the Board considers them to be in the best interest of our neighborhood. We appreciate your support and encourage you to complete the “First Amendment Ballot” with a FOR Amendment by Tuesday, September 26, 2023.
